Section 3999.21 – Language is permissive, statement must be approved by Insurance Department “Any person who, with the intent to defraud or knowing that he is facilitating a fraud against an insurer, submits an application or files a claim containing a false or deceptive statement is guilty of insurance fraud.” The section also states that the absence of a warning is not a defense against prosecution for insurance fraud.
